Topic: A Litigator’s Playbook
This CLE will delve into the complexities of modern trust and estate litigation, covering topics such as breach of fiduciary duty, will contests, and trustee removal. Participants will gain practical insights about how discovery impacts these claims and how litigators can prepare for and mitigate potential family conflict. The session will also address recent case law and legislative updates impacting trust and estate administration and litigation.
Speakers: Evan Nelson, Esq. and Carly Johnson, Esq.
Evan Nelson is a partner at Maslon LLP. He is a self-described “death and dirt” lawyer. He represents clients in trusts and estate disputes, which often come to a head after a family member has died, and in real estate litigation, where clients dispute who owns and controls access to "dirt." Because the two often intersect, as people will gift land (or attempt to do so) via their wills or trusts, Evan’s distinct capabilities prove particularly beneficial.
Carly Johnson is an associate with Maslon LLP, a current ABA Real Property, Trust & Estate Fellow, and a frequent speaker on trust and estate litigation topics. She represents clients across a broad range of general commercial disputes, with a particular emphasis on trust and estate litigation, including guardianships/conservatorships, contested estates, probate, and elder law matters. She also advises clients on construction and real estate disputes. Carly serves as an elected member of the Oak Park Heights City Council.
